1. Acceptance of Terms

By accessing or using the Smallverse Market platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and Smallverse Market.

By creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

To use the Platform, you must:

• Be at least 13 Earth years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Platform under any applicable law
• Provide accurate and complete registration information
• Not have been previously banned from the Platform

3. Your Account

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your password and account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up to date

Account Security

We implement security measures including session fingerprinting, IP tracking, and bcrypt password hashing. However, you are responsible for safeguarding your own credentials. We will never ask for your password outside of the login form.

4. Platform Rules

What We Provide

Smallverse Market provides a platform for:

• Creating and browsing marketplace listings for virtual items and art portfolios
• Communicating with other users through our messaging system
• Expressing interest in listings and managing buyer-seller interactions
• Leaving reviews and building reputation within the community

What We Do NOT Provide

5. Listings & Transactions

Creating Listings

When you create a listing, you agree that:

• All information in the listing is accurate and truthful
• You have the right to sell or offer the virtual item or service described
• The listing complies with our content guidelines and prohibited items policy
• Images accurately represent the virtual item being listed
• Pricing information is clear and honest

Transactions Between Users

All negotiations, payments, and deliveries happen privately between users outside the Platform. When you engage in a transaction with another user:

• You are solely responsible for verifying the other party's identity and trustworthiness
• You are responsible for negotiating fair terms, pricing, and delivery methods
• You are responsible for the safety and legality of the payment method you choose
• Smallverse Market has no involvement in, and bears no responsibility for, any transaction

Commissions and Virtual Art Portfolios

When commissioning work through the Smallverse Marketplace:

• Agree on scope, timeline, pricing, and revision terms before any work begins
• Use the messaging system to document all agreements
• Consider using virtual payment methods that offer buyer protection
• Both parties should communicate clearly and promptly throughout the process

6. User Content

Your Content

You retain ownership of content you create on the Platform (listings, messages, reviews). By posting content, you grant us a limited license to display, store, and transmit your content as necessary to operate the Platform.

Content Standards

User content must:

• Be original or properly attributed
• Not infringe on intellectual property rights of others
• Not contain hate speech, harassment, or discriminatory language
• Not contain explicit, violent, or otherwise objectionable material
• Not contain spam, misleading information, or deceptive practices
• Not promote illegal activities or substances

Content Moderation

We reserve the right to remove content that violates these Terms, at our sole discretion, without prior notice. Repeated violations may result in account suspension or termination.

7. Prohibited Conduct

You agree not to:

• Create multiple accounts to circumvent bans or restrictions
• Use automated tools (bots, scrapers) to access the Platform
• Attempt to gain unauthorized access to other accounts or systems
• Impersonate another person or entity
• Transmit malware, viruses, or other harmful code
• Collect other users' data without their consent
• Use the Platform for any illegal purpose
• Circumvent rate limits or security measures
• Engage in spam, phishing, or social engineering attacks
• Sell, transfer, or share your account credentials
• List counterfeit, stolen, or illegal virtual items
• Manipulate reviews or reputation scores
• Use the Platform to send unsolicited communications (spam)

8. Disputes & Resolution

User-to-User Disputes

You agree to resolve disputes directly with the other party involved. We strongly recommend:

• Communicating clearly through the Platform's messaging system
• Documenting all agreements and conversations
• Using payment methods with built-in dispute resolution (where available)
• Being respectful and professional in all communications

Disputes with Us

If you have a dispute with Smallverse Market, you agree to first attempt to resolve it informally by contacting us on our Discord. We will attempt to resolve the dispute within 30 days.

Reporting Users

If you believe a user is violating these Terms, please use the reporting feature on the relevant listing or profile. Provide as much detail as possible to help us investigate.

9. Disclaimers

We do not warrant that:

• The Platform will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Platform will be accurate or reliable
• The quality of any listings, messages, or other content will meet your expectations
• Any errors in the Platform will be corrected

You use the Platform at your own risk. We are not responsible for the conduct of any user, whether online or offline.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• Smallverse Market shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim (which is $0, as the Platform is free to use)
• We are not liable for any damages resulting from transactions between users, loss of data, or unauthorized access to your account

11. Termination

By You

You may delete your account at any time through the Settings page. Account deletion is permanent and cannot be undone. Your data will be removed from our active systems.

By Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in prohibited conduct
• Your account is used for fraudulent or illegal activities
• We are required to do so by law
• We discontinue the Platform (with reasonable notice where possible)

Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or in a court of competent jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
